Terms of Service

1. Introduction and Acceptance

This Agreement is a legal contract between you (the "User") and Trading Scenarios ("we", "us", or "Company") governing your use of the Trading Scenarios application, including mobile apps and web platforms, and the Smart Money Concepts (SMC) analysis platform (collectively, the "Service").

By installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by all terms of this Agreement. If you do not agree, you must immediately cease using the Service.

2. License Grant and Scope

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Service on devices you own or control
• Access analysis data and market information for personal use
• Utilize the SMC analysis tools for your individual trading decisions

This license does not include the right to:

• Use the Service for commercial purposes without authorization
• Sublicense, sell, rent, lease, or otherwise transfer the Service
• Modify, reverse engineer, or create derivative works
• Remove or alter any proprietary notices or labels

3. Permitted and Prohibited Uses

3.1 Permitted Uses

• Educational purposes to understand Smart Money Concepts
• Supporting your individual trading decisions
• Analyzing price action and market structure

3.2 Prohibited Uses

• Redistribute or resell the analysis data or platform access
• Use the Service to provide commercial advisory services
• Share your account credentials with others
• Automate data extraction or scraping
• Circumvent rate limiting or security measures
• Use the Service for illegal or fraudulent activities
• Interfere with or disrupt the Service's operation
• Create signal services or trading groups based on our analysis

4. Intellectual Property Rights

All intellectual property rights in the Service, including but not limited to:

• Smart Money Concepts analysis algorithms and methodologies
• User interface design and application code
• Educational content, charts, and visualizations
• Trademarks, logos, and branding materials
• Documentation and support materials

are owned exclusively by Trading Scenarios or our licensors. This Agreement does not grant you any ownership rights to the Service or its content.

5. Subscription Terms

Subscriptions are billed through the platform's payment system. You may cancel your subscription at any time, and you will continue to have access until the end of your current billing period.

Due to the immediate delivery nature of digital services, refunds are generally not available. Exceptions may be considered at our discretion within 7 days of purchase.

6. Data and Market Information

6.1 Data Sources

Market data is sourced from third-party exchanges (including Binance Futures and others). We do not guarantee the accuracy, completeness, or timeliness of such data.

6.2 Analysis Limitations

SMC analysis results are generated algorithmically and should be considered educational tools, not guaranteed predictions. Market conditions change, and past patterns do not ensure future performance.

7. Financial Risk Disclosure

You acknowledge and understand that:

• You can lose more than your initial investment
• Leverage amplifies both gains and losses
• Market volatility can result in rapid and significant losses
• Technical analysis does not guarantee profitable outcomes
• Smart Money Concepts are analytical frameworks, not certainties
• No trading system or analysis tool can eliminate risk

The Service provides educational analysis tools ONLY. We do not:

• Provide personalized financial or investment advice
• Recommend specific trading actions or positions
• Guarantee profitability or trading success
• Accept responsibility for your trading decisions

You should:

• Consult with licensed financial advisors before trading
• Only trade with capital you can afford to lose
• Understand the instruments you are trading
• Develop and follow a risk management strategy

8. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• Accuracy, reliability, or timeliness of information
• Uninterrupted or error-free operation
• Security against unauthorized access
• Compatibility with all devices or platforms
• Achievement of trading profits or specific results

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADING SCENARIOS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Direct, indirect, incidental, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Trading losses or missed trading opportunities
• Damages arising from use or inability to use the Service
• Reliance on analysis data or market information
• Third-party data errors or exchange connectivity issues
• System downtime, bugs, or technical failures

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Trading Scenarios from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of this Agreement
• Your trading activities or financial losses
• Your misuse of the Service or its data
• Your violation of applicable laws or regulations
• Claims by third parties related to your conduct

11. Term and Termination

11.1 Term

This Agreement is effective from your first use of the Service and remains in effect while you maintain an active account.

11.2 Cancellation by You

You may cancel your subscription at any time through the Service settings. Upon cancellation, you retain access until the end of your current billing period. Your account and this Agreement terminate when your subscription expires and you cease using the Service.

11.3 Termination by Us

We may suspend or terminate your access immediately if you:

• Violate any terms of this Agreement
• Engage in fraudulent or abusive behavior
• Attempt to compromise Service security
• Use the Service for unauthorized commercial purposes
• Fail to comply with fair usage policies

12. Age and Capacity Requirements

The Service is intended for adults with legal capacity to trade financial instruments. You represent that you are:

• At least 18 years of age (or legal trading age in your jurisdiction)
• Not prohibited from trading by applicable regulations
• Capable of entering into binding contracts

13. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with applicable international commercial law principles.

Before filing any formal claim, you agree to attempt informal resolution by contacting our support team. If informal resolution fails, disputes shall be resolved through binding arbitration.

You agree to resolve disputes individually and waive the right to participate in class actions or collective proceedings.

• You have the legal capacity to enter into this Agreement
